REVOCATION NOTICE & REVOCATION FORM
Consumers are entitled to a right of revocation according to the following provisions, whereby consumers are any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity:
A. Revocation Notice
Right of Revocation
You have the right to revoke this contract within 14 days without giving any reasons.
The revocation period is 14 days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of revocation, you must inform us (smarticulate Aleksandra Grabowska, Händelstr. 9, 137327 Leinefelde-Worbis, Germany, Email: shop@memyselfandnight.com) of your decision to revoke this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached sample revocation form, which is not, however, mandatory.
To meet the revocation deadline, it is sufficient for you to send the notification of the exercise of the right of revocation before the revocation period has expired.
Consequences of Revocation
If you revoke this contract, we shall reimburse you for all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notice of your revocation of this contract. We will use the same means of payment for this repayment as you used in the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the revocation of this contract. This deadline is deemed to have been met if you dispatch the goods before the expiry of the fourteen-day deadline.
You bear the immediate costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Premature Expiration of the Right of Revocation
The right of revocation expires prematurely in the case of contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
